1. Definitions and Interpretation
1.1 DefinitionsUnless the context otherwise requires or unless otherwise defined or provided for herein, in this Agreement (including the Recitals), the following words and expressions shall have the following meanings:
1.1.1 “Affiliate”of a Person (the “Subject Person”) shall mean (i) in the case of any Subject Person other than a natural person, any other person that, either directly or indirectly through one or more intermediate persons, Controls, is Controlled by or is under common Control with the Subject Person, and (ii) in the case of any Subject Person that is a natural Person, shall mean and include a Relative of such Subject Person or a person that, either directly or indirectly through one or more intermediate persons is Controlled by such Subject Person;
1.1.2 “Applicable Law” includes all statutes, enactments, acts of legislature or parliament, ordinances, rules, bye-laws, regulations, notifications, guidelines, policies, directions, directives and orders, requirement or other governmental restrictions or any similar form of decision of, or determination by, or any interpretation, policy or administration, having the force of law of any of the foregoing, of any government, statutory authority, tribunal, board, court having jurisdiction over the matter in question;
1.1.3 “Control” (including, with its correlative meanings, the terms “Controlled by” or “under common Control with”) means (a) the possession, directly or indirectly, of the power to direct or cause the direction of management and policies of a person whether through the ownership of voting securities, by agreement or otherwise, or the power to elect more than half of the directors, partners or other individuals exercising similar authority with respect to a Person; or (b) the possession, directly or indirectly, of a voting interest in excess of 50% (Fifty Percent) in a person;
1.1.4 “Lakshya” shall mean M/s Lakshya;
1.1.5 “Platform” shall mean theLakshya website, run by Lakshya;
1.1.6 “Privacy Policy” shallhave the meaning ascribed to it in Clause 2.1;
1.1.7 “Relative” shall have the meaning ascribed to it under Section 2(77) of the Companies Act, 2013;
1.1.8 “Services” shall mean the services that You avail through the Platform;
1.1.9 “Subject Person” shall have the meaning ascribed to it in Clause 1.1.1; and
1.1.10 “You” shall mean the individual/consumer who uses the Platform.
2. Use of the Platform/ Services
2.1 Please note that by visiting the Platform,You are accepting the practices described in this privacy policy (hereinafter referred to as “Privacy Policy”). All users of the Platform are advised to read and understand the Privacy Policy carefully, as by accessing the Platform You agree to be bound by the terms and conditions of the Privacy Policy and consent to the collection, storage and use of data relating to You as provided herein. By using the Platform, You expressly consent to Lakshya’s use and disclosure of Your personal data in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the Terms and Conditions.2.2 This Privacy Policy is subject to change from time to time without notice and it is strongly recommended that You periodically review our Privacy Policy as available on the Platform. 2.3 This Privacy Policy shall not place any limits on what Lakshya does with datathat is no longer associated with an identifiable user of the Platform.
2.4 Lakshya will, as far as reasonably possible, endeavour to respect Your privacy and autonomy while You use the Platform.
3. Collection, Storage and Use of Data related to You
3.1 Lakshyacollects two basic types of data from You in conjunction with Your use of the Platform, i.e. personal data, which is any data that exclusively identifies You (e.g., Your name, email address, telephone number, postal address, credit card data amongst others) and non-personal data, which is data that does not exclusively identify You but is related to You nonetheless such as, data about Your interests, demographics and use of the sites amongst others.3.2 Lakshya will collect, use, process and transfer such personal data, as contemplated in Clause 4, as per Applicable Law.
3.3 Lakshyamay automatically track certain data about You based upon Your behaviour on the Platform. Lakshyauses this data to do internal research on Lakshya’s users' demographics, interests, and behaviour to better understand, protect and serve You in a more efficient and productive manner. This data is compiled and analysed on an aggregatedbasis.
4. Data Collected by Lakshya and Usage of such Data
4.1 Lakshya, on the Platform, collects and storesdata provided by You, including but not limited to,Your:4.1.1 Personal Data - Lakshya collects personal data from You to identify You, to provide You with data required to serveYou and to help Lakshya deliver a superior user experience. The data collected allowsLakshya to provide You convenient access tothePlatform;
4.1.2 Login Credentials - Lakshyacollects data such as Your email address and password which You shall provide during the course of usage of the Platform;
4.1.3 Website Usage data -Lakshya collects and monitors data about how you are accessing and using the Platform, including but not limited to, administrative and support communications with Lakshya and data about the transactions undertaken through the Platform;
4.1.4 Location - Lakshyacollects and monitors data about the location of Your device to provide serviceability of Your Services, reduce risks associated with Your application and also provide customised offers to enhance Your overall experience of thePlatform;
4.1.5 Contacts - Lakshyacollects and monitors contacts and accounts information to detect references and accounts information to autofill data during processing Your requests for value added services in order to provide you with an easier and more automated experience of thePlatform;
4.1.6 Financial SMS - Lakshya collects and monitors only transactional SMS about bank transactions, the names of the transacting parties, a description of the transactions, etc. to help us perform a credit risk assessment. No personal SMS is stored and collected; and
4.1.7 Others – As may be explicitly required and requested from time to time.
4.2 When You engage in certain activities on the Platform, such as creating an account, ordering a service, posting a review, requesting data aboutLakshya’s Services,Lakshyamay ask You to provide certain data about Yourself.
4.3 When You use thePlatform,Lakshyacollects and storesYour personal data, which is provided by You from time to time by seeking permissions from You to get the required data. Lakshya’s primary goal in doing so is to provide You a safe, efficient, smooth and customized experience and Services. This allowsLakshyato provide Services and features that meet Your needs, and to customize thePlatform to make Your experience safer and easier, and to improve the Services provided by Lakshya. More importantly, Lakshyacollects personal data from You that we consider necessary for achieving the aforementioned purpose.
4.4 You may also choose not to use a particular service or feature of the Platform and opt out of any non-essential communications from Lakshya. Depending on the activity, some of the dataLakshyaasksYou to provide is identified as mandatory and some is identified as voluntary. If You do not provide the mandatory data for a particular activity that requires it, Youshall not be able to avail the benefits of such activity.
4.5 Lakshyawill only collect and use such data from You that Lakshyaconsiders necessary for achieving a seamless, efficient and safe experience, customized to Your needs and use the personal data to provide Services to You, enhance the operation of the Platform, improve our marketing and promotional efforts, analyse Platform use, improve Lakshya’s Service offerings, to personalise Your experience and to provide You a better experience.
4.6 Where possible, we will indicate the mandatory and the optional fields. You always have the option to not provide Your personal data by choosing not to use a particular service or feature on the Platform. Lakshyaalso collects other identifiable data (Your payment card details and transaction histories on the Platform) from You when You set up a free account with Lakshyaas further detailed below. While You can browse some sections of our Platform without being a registered member as mentioned above, certain activities require registration and Youshall be required to provide the above details. The Platformwill clearly display the personal data it is collecting from You, and You have the option to not provide such personal data. However, this will limit the Services provided to You on the Platform.
4.7 Lakshyaalso uses Your contact data to send You offers based on Your interests and prior activity. Lakshyamay also use contact data internally to direct its efforts for Service improvement, to contact You as a survey respondent, to notify You if You win any contest and to send You promotional materials from its contest sponsors or advertisers.
4.8 Lakshya may use Your contact data for Lakshya’s marketing or advertising purposes. You may note that You are free to opt out of the usage of Your contact data for such purposes at any time by sending an email to: lakshya.epicrafts@gmail.com.
4.9 Further, upon registering on the Platform, You may, from time to time, choose to provide payment related financial data (credit card, debit card, bank account details, billing address, etc.). Lakshya is committed to keeping all such sensitive data/data safe at all times and ensure that such data is only transacted over secure sites of approved payment gateways which are digitally encrypted and provide the highest possible degree of care available under the technology presently in use, however, Lakshya shall not be liable for any breach of Your data, which has been passed on to such approved payment gateways or is out of Lakshya’s scope of Services.
4.10 Lakshyawill not use Your financial data for any purpose other than to complete a transaction with You.
4.11 Whenever You change or access Your account data,Lakshyaoffers the use of a secure server. However, transacting over the internet has inherent risks which can only be avoided by You following security practices Yourself, such as not revealing account/login related data to any other person and informing our customer care team about any suspicious activity or where Your account has/may have been compromised
4.12 If You send Lakshyapersonal correspondence, such as emails or letters, or if other users or thirdparties sendLakshyacorrespondence about Your activities on the Platform, Lakshyamay collect such data into a file specific to You.
4.13 Lakshyadoes not retain any data collected for any longer than is reasonably considered necessary by Lakshyaor such period as may be required by Applicable Laws.
5. Disclosure to Third Parties
5.1 Further, Lakshyamay share Your personal data with other corporate entities and Affiliates, including but not limited to entities and Affiliates in foreign jurisdictions, to facilitate transactions. Your personal data may also be shared by Lakshyaor Lakshya’s Affiliates with a third-party business entity in case of any proposed merger, acquisition or re-organization, amalgamation, restructuring of business, including but not limited to, Credit bureaus financial institutions, body corporates etc. Should such a transaction occur, the other business entity (or the new combined entity) shall be required to follow this Privacy Policy with respect to Your personal data.5.2 Lakshya takes adequate steps to ensure that third parties with whom Lakshya shares personal data with, also adopt reasonable level of security practices and procedures to ensure the privacy and security of Your data.
5.3 Where any service requested by You involves a third-party, such data, as is reasonably necessary by Lakshyato carry out, Your service request may be shared with such third party. Lakshyamay also engage with other companies/ persons to perform functions such as order fulfilment, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing payments and providing customer service. They may have access to the personal data needed to perform their functions.
5.4 Lakshyamay be required to disclose any data that is lawfully sought from it by a judicial or other competent body pursuant to Applicable Laws or in order to detect, prevent or address fraud, security or technical issues pertaining to the Platform and protect Lakshya and its assets against imminent harm to its rights, properties and/or safety.
6. Lakshya’s Cookie Policy
6.1 Lakshya sends cookies (small files containing a string of characters) to Your computer, thereby uniquely identifying Your browser. Cookies are used to track Your preferences, help You login faster and determine user trends. Most browsers are initially set up to accept cookies, however, Youmay note that You can reset Your browser to refuse any/all cookies or require them to indicate when a cookie is being sent to Lakshya. You are requested to note that some of Lakshya’s features, which are intrinsically linked to the cookies, may not function properly if Your browser disables the cookies.7. Link to Other Sites
7.1 The Platform may contain links to thirdparty websites that may collect personally identifiable data about You. Lakshyais not responsible for the privacy practices of such websites which Lakshyadoes not manage and control.8. Security Precautions
8.1 The Platform intends to protect Your personal data and to maintain its accuracy as confirmed by You. We implement reasonable physical, administrative and technical safeguards to helpLakshyaprotect Your personal data from unauthorized access, use and disclosure. For example, Lakshyaencrypts all sensitive personal data when Lakshyatransmits such data over the internet. We also require that our registered third party service providers protect such data from unauthorized access, use and disclosure.8.2 We use industry-standard security measures (SSL encryption, firewalls, access control) to protect your data from unauthorized access or misuse.
8.3 Our Platform has stringent security measures in place to protect the loss, misuse and alteration of data under control. Lakshyaendeavours to safeguard and ensure the security of the data provided by You.
8.4 While no computer system is completely secure, the measures implemented by Lakshya’s payment partners reduce the likelihood of security problems to a level appropriate to the type of personal data involved.However, You are requested to note that Lakshya shall not be responsible for any loss, unauthorised access, safety issue or any harmcaused to You by any misuse of Your personal data, unless it is a direct and foreseeableconsequence of negligence and non-compliance on its part only. You hereby acknowledgethatLakshyais not responsible, in particular, for any third-party action or action on Your partleading to loss, damage or harm to You or any other person.Lakshya shall not be held liable for any loss whatsoever incurred by You due tounauthorized access to Your electronic devices.
9. Your Consent
9.1 By using the Platform and/ or by providing Your data, You consent to the collection and use of the dataYou disclose on the Platform in accordance with this Privacy Policy, including but not limited to Your consent for collecting, using, sharing and disclosing Your data as per this Privacy Policy.9.2 If Lakshyadecides to change thePrivacy Policy, Lakshyawill post those changes on this page so that You are always aware of what data we collect, how we use it and under what circumstances we disclose it.
9.3 You shall have the option of withdrawing consent previously provided to Lakshya with respect to Your personal data. However, You are requested to kindly note that exercising this option may hamper Lakshya’s ability to provide You with any/all the features of the Platform. In order to delete Your personal data You may send Your personal data deletion request to Lakshya through email:lakshya.epicrafts@gmail.com.
9.4 All disputes would be handled by the courts in Prayagraj.
10. Choices Available regarding Collection, Use and Distribution of Data
10.1 To protect against the loss, misuse and alteration of the data under its controlLakshyahas in place appropriate physical, electronic and managerial procedures. For example, Lakshyaservers are accessible only to authorized personnel and Your data is shared with employees and authorized personnel on a need-to-know basis to complete the transaction and to provide the Services requested by You.10.2 Although Lakshyaendeavours to safeguard the confidentiality of Your personally identifiable data, transmissions made by means of the internet cannot be made absolutely secure. By using the Platform, You agree that Lakshyashall have no liability for disclosure of Your data due to errors in transmission and/or unauthorized acts of thirdparties.
10.3 Please note that Lakshya shall not ask You to share any sensitive data or data via email or telephone. If You receive any such request by email or telephone, please do not respond/divulge any sensitive data or data and forward the data relating to the same to Lakshyafor necessary action.
11. Communication with Company
11.1 In the event You reach out to Lakshyawith a problem or a query, Lakshya shall retain such communications in order to process and respond to Your queries as also to improveLakshya’sServices.11.2 If You wish to correct or update any dataYou have provided, You may do so online, on the Platform itself. 11.5 The grievance officer at Lakshya shall, within 24 (twenty-four) hours from the receipt of Your email acknowledge Your email and shall dispose the same as per Applicable Law.
